Terms of Service

These terms are an agreement between you and Getkapshn (“we”, “us”) for using the Getkapshn website and app (the “Service”). By creating an account or using the Service, you agree to them and to our Privacy Policy. If you don't agree, don't use the Service.
1. The Service
Getkapshn makes transcripts and captions from the video and audio you upload, lets you edit and style them, and exports subtitle files and captioned videos. Transcripts are produced by artificial intelligence (Google's Gemini service) and can contain mistakes, including wrong words, names, timing or language. Check your captions before you publish them; you are responsible for what you publish.
We are improving the Service all the time and may add, change or remove features. We will try to give notice of changes that take away something important.
2. Your account
- You must be 18 or over, or use the Service with a parent or guardian's permission and supervision.
- Give a real email address you control, and keep your password secret.
- You are responsible for everything done through your account. Tell us at once if it is misused.
- One free account per person. Creating several accounts to get extra free minutes or exports is not allowed.
3. Your content
You own what you upload and what you make with it, including transcripts, captions and exports. You give us a limited permission to store, copy, process and transmit your content only as needed to run the Service for you (for example, sending audio to our transcription provider and rendering your videos). This permission ends when you delete the content or your account, except for copies in backups that expire on their own and anything we must keep by law.
When you upload content, you promise that:
- you own it or have permission to use it, including any music, footage, voices and people who appear in it;
- you have the right to use any font you upload (many fonts don't allow uploading to online services; check the font's licence);
- it doesn't break any law or anyone else's rights.
4. What you must not do
- Upload content that is illegal, sexually exploits children, promotes terrorism or violence, harasses or threatens people, or infringes copyright or other rights.
- Upload someone's private recordings or personal information without their permission.
- Try to break, overload or get around the Service's security, plan limits or rate limits, or access other users' accounts or content.
- Use bots or scripts to create accounts or to use the Service in bulk without our written permission.
- Resell or rent the Service itself, or copy it to build a competing product.
We may remove content or suspend accounts that break these rules, and report illegal content to the authorities.
5. Plans, limits and payments
Each plan has limits, such as upload size, video length, transcription minutes and exports per month, shown on our website and in your dashboard. Limits reset monthly and unused amounts don't carry over. We may change the free plan's limits at any time.
Paid plans aren't on sale yet, and any prices shown are examples. Before paid plans open, we will add the payment, renewal, cancellation and refund terms here, and they will apply only to purchases made after that.
6. Availability
We work to keep the Service running, but it may sometimes be slow or unavailable, for example during maintenance or when a provider we depend on has problems. Keep your own copies of anything important; the Service is not a backup service.
7. Ending your use
You can stop using the Service at any time and ask us to delete your account by emailing [CONTACT EMAIL]. We may suspend or close your account if you break these terms, if the law requires it, or if your use puts the Service or other users at risk. Where we reasonably can, we will tell you first and give you a chance to download your exports.
8. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we don't promise that it will be error-free or uninterrupted, or that transcripts and captions will be accurate or fit a particular purpose. Nothing in these terms removes rights you have under consumer protection law that can't be excluded.
9. Limit of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost views, lost data or damage to reputation. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim, or NPR 5,000 if you haven't paid us anything. These limits don't apply where the law doesn't allow them, such as for fraud or harm caused deliberately.
You agree to cover our reasonable losses if a third party makes a claim against us because of content you uploaded or your breach of these terms.
10. Changes to these terms
We may update these terms. We will change the date at the top, and for significant changes we will tell you by email or in the app at least 14 days before they take effect. If you keep using the Service after that, the new terms apply; if you don't agree, you can close your account.
11. Law and disputes
These terms are governed by the laws of Nepal. Please contact us first so we can try to resolve any problem informally. If we can't, the courts of Nepal will decide the dispute, unless the law of the country where you live gives you the right to go to your local courts.
